Prehearing and Hearing Regulations: The Appeals Board proposes amendments to California Code of Regulations, title 8, sections 370, 371, 371.1, 373, 374, 374.2, 374.3, 376, 378, and 383 which will, among other things, move the deadline for reply papers up, move the prehearing conference to 60 days before the hearing, clarify that Administrative Law Judges (ALJs) may order status conference and prehearing conference statements and if satisfied with the status conference statements, the ALJ can take the status conference off calendar, list common topics the ALJs may order be covered in the prehearing conference statement, and clarify that failure to submit a status or prehearing conference statement ordered by the ALJ may subject a party to sanctions, update regulatory language, citations, and make changes to increase consistency across the OSHAB regulations.

Completed Rulemaking
Concerning Time and Place of Hearing: The Appeals Board amended California Code of Regulations, title 8, sections 372.6, 372.8, 376, and 376.8 which, among other things, govern, address, and permit the occurrence of Board hearings via videoconference, and clean-up small issues from prior rulemakings. These regulatory changes became effective on July 1, 2023.
