Motor Carrier Employer Amnesty Program (AB 621)

Effective January 1, 2016, Assembly Bill 621 adds Section 2750.8 to the Labor Code also known as the Motor Carrier Employer Amnesty Program.

Under this program, motor carrier companies that qualify can avoid liability for misclassification of drivers as independent contractors if the companies voluntarily enter into settlement agreements with the Labor Commissioner by January 1, 2017. The motor carrier must agree to convert all its drivers to employees and pay all wages, benefits, and taxes owed, if any.

Motor carrier companies interested in participating in this amnesty program must fill out the Motor Carrier Employer Amnesty Program Application. If the application is approved, further instructions and forms will be provided by the Labor Commissioner’s Office and the Employment Development Department (EDD).
